GENERAL INFORMATION
WAM is a company governed by French law, domiciled in France at 120 rue Jean de Guiramand, 13290 AIX-EN-PROVENCE, FRANCE.
Commercial transactions are subject to these General Terms and Conditions of Sale (CGV), which take precedence over any purchase conditions unless formally and expressly waived by WAM. WAM exclusively addresses dental surgeons and professional structures in the field of dentistry, not consumers. Anyone violating this provision may face legal action and be held liable for any damages suffered by WAM as a result. Any order for supplies placed in writing, by phone, via the internet, or at a trade show implies acceptance of the CGV listed below.
WAM reserves the right to remove or modify its selection of dental products and supplies without prior notice. These CGV may be modified at any time, and the applicable version is the one available on the website www.wamkey.com at the time the order is validated by the customer.
DELIVERIES
The customer must ensure that delivery to the provided address is possible during standard delivery hours in an acceptable and secure manner for the packages.
The customer must ensure that they or a trusted person can personally receive the package.
WAM encourages each customer to check the conformity of products upon receipt. This includes:
The condition of the packaging
The general condition of the received equipment
The number of packages received
This verification is the exclusive responsibility of the customer.
Consequently, any delivery that has not been subject to formal, precise, and detailed reservations on the signed delivery slip handed to the carrier will be considered irrevocably accepted by the customer.
Please note that the mention "subject to unpacking" is not accepted. However, reservations accepted by WAM’s partner carriers include: "damaged package," "open package," "torn package," "wet package," "missing package."
In case of an issue, the customer must notify WAM within 24 hours by email with photos of the package(s), a precise description of the reservations, a sworn statement, and a copy (front/back) of their CNI.
Without this information, WAM cannot file a claim with the subcontracted carrier.
An exchange or reshipment of goods will only be possible if the procedure described above is followed and the carrier's investigation has been completed.
WAM reserves the right to split the order into multiple shipments and cannot be held responsible for delivery delays due to carrier failure of any kind.
WAM is not responsible for partial deliveries due to stock shortages or temporary or permanent unavailability caused by a supplier failure.
RETENTION OF TITLE CLAUSE
The goods covered by this contract are sold with a clause expressly subordinating the transfer of ownership to full payment of the principal amount and related costs. It is understood that merely issuing a payment instrument, such as a bill of exchange, does not constitute payment within the meaning of this clause, and the seller's original claim against the buyer remains with all associated guarantees, including the retention of title, until such payment is effectively made.
The above provisions do not prevent the transfer of risks of loss or deterioration of the goods upon delivery, nor the damages they may cause. The buyer must subscribe to insurance covering these risks from the moment of delivery.
Until full payment is made, the buyer must individually identify the delivered goods and not mix them with similar goods from other suppliers.
Failing individual identification, WAM may demand reimbursement or reclaim goods still in stock.
Notwithstanding any contrary clause, if the buyer fails to meet a payment deadline, WAM may demand, by registered letter, the return of the goods at the buyer’s expense until full compliance with their obligations.
In case of garnishment or any third-party intervention on the goods, the buyer must immediately inform WAM to allow it to oppose and preserve its rights. The buyer is prohibited from pledging or assigning ownership of the goods as security.
SHIPPING COSTS
Unless otherwise stated in writing, shipping costs are borne by the customer.
Sales outside mainland France: Unless otherwise explicitly and in writing granted by WAM, any order not intended for mainland France must be validated via the website or email and paid in full upon ordering. Shipping, packaging, freight forwarding, insurance, and all import-related costs and taxes are the customer’s sole responsibility. Before confirming their order, the customer must complete all administrative procedures to ensure they are authorized to import the products under the regulations in the destination country.
PAYMENT TERMS
By default, orders are shipped only after full payment has been received. However, the website www.wamkey.com may, in some cases, offer the customer more flexible payment options, such as payment in three installments or upon receipt.
These conditions are not automatically granted to the customer. WAM reserves the right to request an upfront payment of a larger portion or the full amount of the order.
WAM retains ownership of the product until the buyer has fully paid for their order.
Invoices are sent electronically in accordance with digitalization laws (Ordinance No. 2021-1190 of September 15, 2021).
If payment is not received within the specified invoice period, the due amount will automatically incur a late penalty equal to five times the legal interest rate, with a minimum of 12.66%, and additional collection fees. Furthermore, if payment is over 30 days late, a penalty of 20% of the unpaid amount (minimum €30 per installment) will be applied without prior notice. Additionally, a fixed recovery fee of 12% of the recoverable amount will be charged to the buyer.
PRODUCT WARRANTY
The warranty applies exclusively to manufacturing defects, excluding any misuse or deviation from the usage protocol. The warranty duration is specified on each device’s webpage on wamkey.com and/or in the manufacturer’s documentation.
The warranty does not cover:
Defects from materials or parts supplied by the customer
Maintenance not performed per manufacturer specifications
Modifications without written manufacturer approval
Normal wear and tear
Damage due to accidents or negligence
Improper or inappropriate use
Expired devices
Manufacturer-excluded cases
For warranty claims, customers must submit a request via the "support and return request" form on wamkey.com. Some items may need to be returned following WAM’s instructions. No returns will be accepted without prior written agreement and return authorization number.
If the warranty is granted, the manufacturer may choose to replace or repair the defective equipment free of charge. The exchanged parts will be new or equivalent.
If the warranty is not granted, a quote may be provided to the customer to repair the equipment.
If no repair is possible or if the quote is rejected by the customer, the customer may request the return of the equipment at their own expense and under their sole responsibility.
The customer is responsible for selecting the products and ensuring their suitability for their needs.
The customer must verify the product usage conditions, including precautions for use, expiration dates, and compliance with regulations.
MONEY BACK GUARANTEE
If the specific conditions (order form, delivery note, or invoice) provide for it, the "money back" warranty applies exclusively under the following conditions:
The warranty is valid for 15 days after delivery.
To benefit from the warranty, the products must be returned—after WAM has verified that the conditions for exercising the warranty have been met—undamaged and in their original packaging and wrapping, along with the completed return form and a photocopy of the purchase invoice.
The packaging and return shipping costs are the responsibility of the customer.
In all other cases, the warranty cannot be applied.
WAM reserves the right to adjust product prices without notice due to currency fluctuations or precious metal price variations. Only the pre-tax price is guaranteed.

GIFT VOUCHERS
Vouchers are individually issued on the customer’s account page on the website. Each voucher is issued upon receipt of full payment for the invoice related to the items benefiting from the offer. Unless otherwise validly communicated by WAM in writing, it is non-transferable and valid for 3 months from its issue date.
WAM cannot be held responsible for any typographical errors that may appear on its website or any other communication medium. Photos have no contractual value.
ENVIRONMENT/DEEE
The unique identifier FR385777_05HIBO certifying registration in the producer registry for the EEE sector, under Article L.541-10-13 of the Environmental Code, was assigned by ADEME to WAM (SIRET: 43323146100065). This identifier attests to WAM's compliance with the obligation to register with the producers of Electrical and Electronic Equipment and its submission of market introduction declarations to Ecosystem.
DATA PROTECTION LAW – RIGHT OF ACCESS
In accordance with the GDPR and the "Informatique et Libertés" law of January 6, 1978, as amended, the customer has the right to access (Article 15 of the GDPR) and rectify (Article 16 of the GDPR) their personal data, as well as the right to request the restriction of their data processing (Article 18 of the GDPR). The customer can exercise these rights by sending their request to wam@wamkey.com.

WAM retains intellectual property rights over all documents, videos, photos containing technical or commercial information, and products it manufactures and sells.

The General Terms and Conditions (GTC) are governed by French law. In the event of a dispute related to the interpretation or execution of the GTC, the parties should attempt to reach an amicable agreement. In case of litigation, the Commercial Court of Aix-en-Provence has exclusive jurisdiction.
